These terms apply to the booking and provision of passenger transport services through the Berlin Taxi Airport website. The customer is an adult natural person who books for themselves or for other passengers. When booking for a third party, the customer must inform the passenger of these terms and provide accurate contact details.
2. Subject matter of the contract
Berlin Taxi Airport undertakes to arrange and provide the confirmed transport on the agreed route; the customer provides the required information and pays for the journey. The pickup location, destination, date, time, number of passengers and items of luggage, vehicle class, additional services, flight number and total price are specified in the booking confirmation.
Berlin Taxi Airport may use licensed transport companies and drivers. Its obligations towards the customer remain unchanged unless the booking confirmation expressly states otherwise.
3. Booking and conclusion of the contract
Before placing the order, the customer can review and correct the information entered. By clicking the button to place an order with an obligation to pay, the customer submits a binding offer under the conditions displayed immediately beforehand. An automatic acknowledgement of receipt does not constitute acceptance unless expressly described as such.
The contract is concluded when the booking confirmation is issued by email or in the customer account. If the booking is not accepted, any payment already received will be refunded using the same payment method. The customer must check the confirmation and report any errors without delay.
4. Price and payment
The total price is displayed before the order with an obligation to pay is placed and includes applicable taxes and selected additional services. Further charges arise only for separately selected or subsequently agreed changes. Payment is made online using a payment method offered on the website. Complete card details are processed by the payment service provider and are not disclosed to Berlin Taxi Airport.
5. Pickup and performance
The passenger must be at the confirmed meeting point at the agreed time and remain reachable on the telephone number provided. The meeting point and waiting conditions are specified in the booking confirmation.
For airport pickups, an accurate flight number must be provided and any changes must be reported without delay. If the flight details are correct, the actual arrival time can be taken into account. The included waiting time is specified in the booking confirmation.
The driver may choose an appropriate route, taking account of traffic, safety and official instructions. Arrival and journey times are estimates and may change, particularly because of congestion, road closures, weather or other circumstances beyond reasonable control.
6. Vehicle
The booked class determines capacity and service level but does not guarantee a particular make, model, colour or year of manufacture. An equivalent or higher-class vehicle may be provided at no additional cost. If no suitable replacement is available, an alternative will be offered or the charge for the service not provided will be refunded.
7. Passengers, children and luggage
The number of passengers, children and items of luggage must be stated in full and must not exceed the vehicle's capacity. Child seats, children's ages, and bulky, valuable or special luggage must be declared in advance. Dangerous, prohibited or unlawful items will not be transported. Luggage that cannot be stowed safely may be refused.
8. Passenger obligations
The passenger must follow the driver's lawful instructions, wear a seat belt, refrain from interfering with the journey, and must not smoke, consume prohibited substances, or damage or soil the vehicle. The driver may refuse or terminate transport in the event of unlawful conduct or conduct that endangers safety. To the extent provided by law, the customer is liable for damage actually caused by the passengers.
9. Booking changes
Requests for changes must be submitted through the customer account or to info@berlintaxiairport.de. A change takes effect only after written confirmation and is subject to availability. Changes to the route, time, class, number of passengers or items of luggage, or additional services may change the price.
10. Cancellation
The customer may cancel the booking free of charge no later than 24 hours before the agreed pickup time. For a later cancellation, the fare will not be refunded. The customer may demonstrate that no loss, or a substantially lower loss, was incurred.
Refunds are made using the same payment method; the time required for the credit to appear depends on the payment service provider and the bank. If Berlin Taxi Airport cancels the journey and does not provide an equivalent replacement, the charge for the service not provided will be refunded.
11. No-show
A no-show occurs when the passenger does not appear at the meeting point by the end of the confirmed waiting period and cannot be reached using the contact details provided. Before this, the driver or dispatcher will make a reasonable attempt to establish contact. A no-show is treated as a late cancellation; the customer may demonstrate that no loss, or a lower loss, was incurred.
12. Delay by Berlin Taxi Airport
If a substantial delay is anticipated, the customer will be informed where possible. If the purpose of the journey can no longer be fulfilled because of a substantial delay for which Berlin Taxi Airport is responsible, the customer may withdraw from the contract and request a refund for the service not provided. Any further claims are governed by law.
13. Liability
Liability remains unlimited in cases of intent and gross negligence, for damage arising from injury to life, body or health, and in all cases where a limitation is prohibited by law. In the event of a simply negligent breach of an essential contractual obligation, liability is limited, to the extent permitted by law, to the typical and foreseeable loss.
There is no liability for delays or impediments to performance that could not have been prevented even with reasonable care, including road closures, official measures, extreme weather, accidents, strikes or disruption to transport infrastructure. Mandatory passenger rights remain unaffected.
14. Right of withdrawal and contractual cancellation
For contracts for the transport of passengers, there is no general fourteen-day right of withdrawal for distance contracts in the cases provided for by law. The contractual cancellation right under section 10 remains available.
15. Complaints, refunds and data protection
Complaints must be sent to info@berlintaxiairport.de and include the booking reference, journey date, route, passenger name and details of the matter. A refund does not restrict mandatory consumer rights.
Personal data is processed for booking, performance, communication, payment and compliance with legal obligations. Required data may be shared with drivers, transport companies used and payment service providers. Further details are provided in the Privacy Policy.
16. Applicable law and final provisions
The law of the Federal Republic of Germany applies. This choice of law does not deprive consumers of the mandatory protection provided by the law of their country of habitual residence. Jurisdiction is determined by law; exclusive jurisdiction in Berlin is not agreed for consumers.
The booking confirmation forms part of the contract. Individual agreements take precedence. If any provision is invalid, the remaining provisions remain unaffected and the statutory rule applies in its place. The version applicable when the order is placed, which can be saved or printed, is authoritative.
